colorado warrent issued while in prison

my husband who is currently in a correctional center was suppose to be released on the 25th of this month but now his casemanager said that as soon as he is released he needed to go to the county jail because he has warrents out for his arrest . hes been in prison for the past 8 years . my question is shouldnt the courts have taken care of that when he was arrested the first time before he went to prison? what if someone used his name while he was in prison what will happen ? if someone used his name and they find out it wasnt him can they still charge him with whatever the charges are?will this effect his parole? can i bond him out even though hes on parole? will this effect his parole?is there anything he can do to avoid going to jail or staying in jail? please help? thank you

why are you speechless i thaught that when he went to the county the first time then that should have taken care of all warrents he had am i right? i just dont know what to do

A person goes to prison for the crimes which they are sentenced on. All because they have been convicted on one crime does not mean they are absolved of the others. If the warrant issued after he was in prison - which is very possible, and it does happen - then the court that issued it may decide to simply sit on it and wait for release (IF they know where he is). It can be expensive to transport a person from state prison and back again several times for court ... depending on the process.

So, now he has to answer for the new offense. Th ebest thing you can do is get him an attorney.

No. They go to jail for the charges they went to jail on. The others do not automatically get resolved.

You can only be charged with what you do.

It's pretty obvious that if he is being charged with something that occurred while he was in prison that he has a alibi!

they told him that after he is released for his parole he has to report to the county jail .. what will happen? will they consider that a parole violation and revoke his parole? after he takes care of this warrent will he be able to continue his parole and come home?

It will be a parole violation only if he does not report.

He's just now being put on parole.

Anything bad he does now will be a parole violation.

well hes hasnt had a chance to parole yet he was suppose to be released the 25 of this month and now they said when they are just gonna take him next door to the county jail on that day so he can see what the warrent is for. but he hasnt been released yet. so is that still a violation??

As long as he is in custody of the government, they will take care of his scheduling.

Usually the person who is incarcerated has to request to be allowed to appear if they have other charges to appear on while in custody.It's not required of the facility where they are incarcerated to make sure that that person appears except on the arresting charge.Have him contact his parole agent about the new warrant.If the crime occured while he was in custody,then he can verify his whereabouts at the time the crime was committed,& has nothing to worry about.If a prisoner is on parole or probation they usually have a hold on them & cannot be bailed until it is lifted by thier P.O. Yes the outcome of the charges will affect his parole if he did the crime(s).
