New Jersey: Please HELP! I leased an office space to a tenant who has been a thorn in my side all year. It is a commercial lease with NO time period written into it in regard to how much notice I have to provide for a notice to NOT renew. I sent out the non renewal notice with 60 days notice. It is a one year lease with NO renewal written into it and it was also written that it was an as is condition. The tenant is screaming and yelling that he put five thousand dollars into it and wants a renewal because of that fact. He is demanding a renewl and claims that all ----will hit the fan if I proceed. What is the NJ statute on proper notice and eviction with a commercial lease, please? I have the primary lease on the space and this was a sublet with the landlords permission as well. This is stressing me out because the tenant is SO nasty and such bad karma for the building . . .a real bully. PLEASE, can you give me some advice? I work in the building as well . . .I just want my space back and my peace. P.S. The tenant is an attorney who tried to get me many many times to give him a renwal option and I refused. Both of the items regarding the non renwal and the as is condition were intialed by the subtenant and me. The tenant certainly did NOT put five thousand dollars into the one room office. He did the work himself and it consisted of some sheet rock and paint. The new carpet is not glued down and he will take it with him. And he BRAGGED for weeks that his renovations were "free" because he did it himself. It is certainly not a big office: one 13x14 room and that's it. He is a very disruptive fellow who even tries to bully a very nice female tenant . . .he is awful, awful, awful.
I am more than a little worried this fellow is AWFUL!! THank you so very much for any help you can offer to me.

Bad energy . . .

If he had wanted to stay, he should have been a good tenant. Instead, he bulled everybody, even his wife and kids. There was never any peace and this buildinghad been so peaceful for so many years. I have honored the end of lease, and now I wnt my space back.

He is pounding up and down the stairs and claims that all shoot is going to hit the fan. He knows that I live here and that my office is here . . .I do NOT want hinm to stay as a tenant or anything else!! :confused:

**A: common sense dictates that you level the playing field and hire your own atorney. Better yet, hire a real esatte attorney t hat specializes in commercial property evictions. Have the attorney send a certified rrr letter to terminate the m/m lease. You have consistently allowed yourself to be treated this way. And that is awful.

And your lease (if you used a standard commercial lease) would have something in there about all improvements made to the property (with the exception of trade fixtures) shall remain with the property after expiration of tenancy, meaning that carpet is yours too. Unless your lease states different. Take Gurus advice though and get a good RE attorney. Was a sublet allowed in your lease?

The no time limit in the Lease could be to your benefit... Maybe ?

Let your Real Estate lawyer tell Thorny to take a hike... Use some of the rent he is paying you and get that letter out...STAT.

Now Go Jersey Girl... Go.
( if I am assuming your gender... sorry... just don't think that many men from Jersey use the word Karma :o )

Thank you for the kindness of your response. I am very overwrought because my mother AND my 14 year old Labrador are dying at the same time. I live at the hospital and this tenant has followed me into the building to point his finger at me and warn me that he has a "message" for me. He is REALLY scaring me and he also said that "those who live in glass houses should not throw stones and that all shoot will now hit the fan . . .big time." he has even harassased the 16 year old dogwalker because she would not know him and would not let him in the front door of the building (per my instuctions.) He did not have a key (to her he was a "stranger" and it was 9pm . . . he is a powder keg!
The lease is a commercial lease from Home Depot and the term is one year with no renewal option and rented as is. He is FURIOUS that I will not renew and believe me I never will renew. The owner of the building is on my side, I have had the primary lease for 14 years and this hothead is a subtenant.

He called the owner of the building and left a message that he will pursue legal action if the owner "will not work something out." There is NO way I want this wacko in the building . . .he even attended a private reformatory for high school! He likes to point his finger and warn women, children, and dogs. What does that tell you? I am very very upset and I have sent him the 60 day notice already RRR as well as regular post and hand delivered as well. Can you tell if I am in good shape with this lease or not? I will be hiring a lawyer as you advised, but I was just wondering, in the meantime, what kind of protection I have with this lease. you are so kind to take thee time to respond. Thank you so very much. I am very exhausted since I spend all of my time with my beautiful mother who is suffering terribly. I am very worried.

Really.. Guru might give you some more advice... but really and I don't mean to say I know the Gu's mind... but he probably will reiterate Get a Lawyer...but then again he is a Lawyer and I have seen him do some pretty amazing stuff. sigh....

sorry... just amazed at his help when he gives it freely.. But he is a busy man.

Tomorrow.. before it gets too late... Get a Real Estate Lawyer to look at your lease.. what you have sent... what he has "said" he needs to know.. if he has "sent" anything... see if there is any plausiblity in his saying that he has renovating has any value... etc etc..
You seem to be nervous about this... is there something besides the fact that the man is a buttcheese that is making you sketchy.

A clause? a leeway? is it signed... Verbal is shinola in leases so he don't got you there.

which he why he is so angry. Signed, initialed, dated and expires April 30th. He is an attorney. However, in almost one year no one has ever seen a single client. It is a cheap rent in a Landmark building and he seems to think that he owns the place. He made unreasonable demands even before the ink dried. I am nervous because he is a bully and I do not like being around someone who acts like he is going to hurt me one way or another. Tomorrow, I am having a lawyer write a letter telling him to stay away from me and that he is expected to leave by April 30th. I also told the cops on the beat exactly what he said to me as well as Bob the Fed EX man, so IF anything happens to me, everybody will know who did it!
This tryant of a tenant is someone who does not like to be told "no." He likes to yell and I am a very quiet person so he freaks me out. Even my dog is horrified. So, now I am very sleepy, I wept all night over my mother and my eyes are aching. I just do NOT need a loose cannon around me . . . he is scary.

worried about . . .when a letter from a lawyer arrives, I think this hothead of a tenant will explode . . . at ME.
