What is the name of your state?
California: I am a commerical driver. This past weekend I was stopped by CHP. CHP indicated that my trailer required mud flaps for each set of wheels. The officer indicated that it was a fix it ticket and checked the box owner's responsibility. I am not an owner/op but instead I work for a large company. I turned the ticket into my company. They noticed that the code the officer used was code" 22348(b)(2)(b) U.C. Flaps behind every set". In looking at the vehicle code, it is for driving over 100 MPH and not the U.C.Flaps behind every set. My employer is stating that since I signed the ticket, I am responsible for it.
My questions are: How do I prove it was not a speeding ticket but instead of a fix it ticket. How do I make my employer responsible for fixing the mud flaps instead of me and what happens if they don't fix the mud flaps? Having a clean DMV record is my livelyhood and I cannot afford to have any tickets on my record let alone one over 100 MPH.!! Help!
 


Go to traffic court and have the clerk or DA amend the defendant to the owner of the truck. Hopefully, it's the trucking company and they will be required to answer to charges.

Make sure you don't lose the ticket.

It also helps if the company owned the truck.

I believe that the ticket is through Palo Alto Superior Court, being Santa Clara County. I think I goofed by giving my employer the original ticket. At the time I gave it to them, I was believing that the vehicle code was properly stating fix it rather than speeding excess of 100 mph. I guess the court would hopefully believe that I nor anyone else in their right mind would drive double gasoline tankers over 100 mph as that is what I was driving. And yes, the truckand trailers are not registered to me but instead my employer. I am worried that they won't fix the trailer as required and I will get my license suspended or fined. Thanks!
 
go to court immediately and do an add on. The court has your file and the original citiation. Have them amend the defendant to the owner as the citation states..."owner's responsibility"

Any paperwork you can bring would be most helpful.
