Company wants to settle but husband still in pain

What is the name of your state? Kentucky
My husband was in an auto accident last April. He was hit by another vehicle that lost control around a 45 mph cruve doing atleast 55 mph and totaled our vehicle in the process. He went to the hospital the day after the accident and was reffered to a specialist afterwards. He was told to give it six months after treatment to see if pain was still an issue. He waited and under certain circumstances , altho still in pain, he was unable to continue is treatment with the specialist. The other insurance company has finally contacted us here recently about settleing his claim ,almost a year later, which is about the same time he has now been able to continue his treatment due to the fact that the pain has made it to where he cant push it any further. I know i dont want to settle till we know the exent of his problems, but we are so ready to get this over and behind us now. They have offered us 1200 for pain and suffering. I was wondering if you think we should keep our bearings and not settle just yet or what. Any advise as to wat we should or could do would be greatly appreciated.

No one here can answer that question, only you can. You can take the $1,200 and settle or you can try and negotiate a higher settlement yourself. Or you can hire an atty who will take a 3rd of the settlement. Also it will probably be a couple years before you see any money if you get an atty. Only you can answer though.

Yes they should be able to give me an answer if they have an opinion or they have gone thru a simular accident before they can give me advise ...isnt that wat this site is about. I dont want to get bite in the end on this and im sure there are alot of ppl on here that feel the same.

hell no! dont take that.in ny the standard insur is like 20,000 min.
you shhould be getting lost wages from no fault,medical bills covered from no fault and then setttle for no less than 10 15 k

whoever offered that was laughing under their breath

i dont know ins in your state but it would be more lucrative to get an attorney.
the 33% will be worth it..

whats his injuries?
take the number your willing to settle for..tack on 25% to it and call the handler.if they refuse than ask whats teir final offer?before you contat an attorney?
then ask foe 25%more than they offer.
and go from there

Lacking information

Little confused about the medical treatment given? Has your husband been to Physical Therapy? Has he seen only the one specialist every six months? What are his injuries? Has he missed work? What are his lost wages? During that time period of recovery did you keep a daily dairy of how all of this has affected you?

Having posted before on this sight before...you WILL NOT get a monetary value on your case, but you will get some insight to whether or not the amont offered his a slap in the face!

I agree get an attorney. If your husband still needs medical attention, get it. I was able to get my wife $1800 for spraining her wrist when hit by a car backing out of a parking space. Although there is no way I can say how this compares to your case, I hope this illustrates how going to an attorney can get you a better settlement amount, than if you did it yourself.

Don't jump all over Lynx... The problem is there are too many factors.

I too am an accident victim... and now a victim to a lawyer too it seems.
I tried to get an answer as well, and learned how many litigating circumstances there are in every single case.

I have a lawyer that does not answer the phone! So I came here.
When I finally spoke to my lawyer, The insurance gave a low-ball settlement that did not even cover my legit medical expenses.
So I cannot even tell you what my quote is, because we are still in negotiations.
Lynx is an insurance adjuster ( I think ) and takes the time to be impartial and honest... So no bashing here.

if you give us some more details we can make a more accurate assumption.

too many people settle for small$$ than 2 years later realize they can no longer bend or squat etc etc.

my wife did this.a small bulge in her neck 4 years ago..didnt seem big at the time.she took 10,000.

today her arm is numb everyday,she cant pick up our son.amongst alot of other things.

if she hadnt got a lawyer,they would have happily gave her the 2,000 they offered before.if she would have known this was gonna be...she would have pursued more funds.

if he is honestly injured dont settle for anything less than what you think he deserves.and the odds are you will come close to it.and if not.trial!!

today her case would be worth over 100,000 to settle.easily.

undefinedOk i wanted to thank everyone for their advise and opinions. I wasnt bashing anyone in the second post. I have just been under alot of crap and i know thats no excuse but i do apologize that it came out rude. I have been dealing with all this for the last 2 months because the insurance company decided to wait a year before tryin to talk to me and my husband about settleing anything. My husband at the moment is the only income coming into the house and altho im looking for work to help and so he can stop working, which he is going to probbly be told by the doctor, here soon he wont be able to work for much longer until his back is figured out. The insurance comapny hasnt not offered anything for his loss wages the 1200 was for his pain and suffering. I have contacted a lawyer which i am seeing in a couple of days to see wat we can do about this. I do feel the 1200 was a slap in the face and cant beileve the odious nature of hte compnay to even think to offer that much. The woman that caused the accident has tripled our debt ratio and the company has allowed us to wait a year to even try to contact us about anything. Its sickening. My husband has only done one line of work since he was 16, so him just running out to find a job that isnt overly physical that pays his current income is hard for him to do. This is the first major accident he or i have ever been involved in so at the moment we are just dumbfounded by the whole thing and because it has been going so fast in the 2 months out of no where we are feeling a bit confused and lost as to what we should be doing. The extent to his injuries were he hada cut under his chin, severe whiplash at the time of the accident. Now he has been in daily pain with his back since the accident, having problems just walking for too long. Also he has been getting headaches from his neck on an occasion. Because him being the only person working for the last couple months it has been hard for him to just go back to the doctor ,specially since we know form the pain he is having from his back they are going to cut his working down a lot, but thank you all for your insight and it all will be greatly weighed.

he hasnt had any mri or exray showing catilage or ligament or bone issues?

does your state have ins called no fault?
here in ny...no fault pays your medical bills,and lost wages among other related expenses.
it doesnt have to be determined whose at fault for these to go into effect.

ins policy and mandatory coverages vary state to state..tell me more
