Hi, I own a small personal training studio and a big competitor gym is closing in my area. The gym has a lot of trainers who are full with clients. Is it legal for me to hire their trainers and have them take their clients with them to my studio?

Why would you think that is illegal? Obviously the big competitor will no longer be in business to provide those services any longer.

By the way, that answer was very general because you erased the question about your state name instead of answering it.

It would be legal for you to hire them; whether the trainers might encounter any trouble depends on what agreements they had with your competitor and in what state you and the competitor are located.

More information would be helpful, including the name of your state.

You can extend offers of employment to the trainers from the gym. Whether they can accept employment with your studio and/or encourage clients from the gym to follow them to your studio depends in large part on their contractual agreement with the gym and if the gym will be operating in a different location (and, if so, where).

What needs to be considered by the trainers are any trade secret provisions in their current contracts (trade secrets of which can include client lists) and any noncompete clauses that could limit their legal ability to work for your studio ...

Is the gym closing down JUST the gym location near you or is it going out of business entirely?
