Dear "You Are Guilty":
As for getting the minutes, I've never had a problem getting them without telling them "why." They offer to give them out as long as you pay for the postage stamp. There is hope for some of us, so please don't claim doom and gloom for all of us because you had some bad HOA abuses. I'm hoping we can all learn from this, and not discourage us from pursuing all that we can to retain our homeowners' rights. Thanks for your comments anyway.

Since you appear to have a tough time understanding basic sentences, I will quote, again, the section of law that applies to this poster. Pay close attention and read slowly:
(c) An inspection authorized by paragraph (b) may be denied to such member or other person upon his refusal to furnish to the corporation, its transfer agent or registrar an affidavit that such inspection is not desired and [highlight]will not be used for a purpose which is in the interest of a business or object other than the business of the corporation[/highlight] and that he has not within five years given, sold or offered for sale any list or record of members of any domestic or foreign corporation or aided or abetted, or attempted or offered to aid or abet, any person in procuring any such list or record of members for any such purpose.

So you see that in NY, without an affidavit which sets forth the requested purpose, there is no legal obligation to even turn over the "basic" (bottom level Board) minutes. It may certainly be different by you, but since that's 3000+ miles away from this poster, it's rather irrelevant to this discussion.

Comprehendo? I definitely comprehendo. Guess that's why I have my minutes and you don't. Now onto better group discussions....

And you obviously live in a much more reasonable HOA then I because they have refused to give me the Executive minutes and the only way to get 'em is through a lawyer and go through the hoops that "you are guilty" has told me.

Now, Today I was emailed that they have agreed to let me view the Management corp. contract and will even let me view it in a Board member's home as going to the business office would be too much of a hardship for me (I have MS) and they have allowed someone to do that before. :rolleyes:

Of course I know they are trying to show they are reasonable folks and even thoughtful and personally I find it insulting as I drive just fine and would rather view it at the business office. They are just trying to block me from insisiting that I see ALL the records.

Moving will be so much easier then dealing with these demented people!! :mad: And now I too am moving on to a better topic!
