complicated divorce/custody case!help

What is the name of your state? GA
5 years ago, my wife up and left our country of residence with our daughter and disappeared. She apparently remarried in the states 4 years ago after getting a third party divorce, for which I wasn't even consulted. How she got it I have no idea. I was unable to locate them, despite hiring people to find them, until last year, when her new husband was seeking to adopt our daughter and therefore had to post it on the internet. I have located them, but am unsure as to the rights I still possess with regards my daughter. Can/Should I request custody, visitation?......

I would consult with an attorney ASAP. Since you have proof that you attempted to locate and where unable. You just found out about divorce / re-marriage / and adoption. The clock is ticking for what you can / can not do.

If you want to see your child, then yes pursue it. If you dont want to, then dont. But keep in mind, in Va, an adoption....after 6 months, no one can come in and contest it. Its final after 6 months. SO check the laws in your state.

But ist up to you .We cant tell you to follow through with it or not. If you want your child or to see your child, then file. If you dont and just want them to go on with life without you, then leave it be. You can also probably stop the adoption from taking place because you are bio-dad, even if you dont want to be totally active in the childs life since it has been years.

What kind of a rant are you on today?
Don't respond to questions if you don't know the law required to answer.
OP is in GA not VA!

Please contact the police, this is parental kidnapping and an attorney re custody and visitation rights.

And rmet-- your not a daggon attonrey. So stop telling people all the time to not answer questions unless they know the law. I know more about law than you, I'm a Litigation Paralegal. Your a brainless pig.

thanx for replying.....
when I said "should" I meant if it would be better going for custody(meaning do i still have righs) or just visitation. I definitely want to be a part of my daughter's life, that is why I have come here from the UK to see what can be done.
I am also apprehensive as to what my ex has been telling my daughter about me............we were so close when she was younger.
I was in contact with a lawyer but he doesn't seem to know what he is doing.we already lodged an application to stop the adoption months ago, then he told me I could go back to the UK and could come back when I was able to spend a long period of time in the US. He keeps telling me everything is positive, but doesn't seem to be doing anything but charging me money like that's all.

Is the child a US citizen? Or a British subject? Have you spoken with British authorities over the past 5 years since Mom took the kid?

I don't know if she is a US citizen, I assume so after her Mum remarried. Also what stopped me from going to the authorities was her family who said that if I did that, and she was charged or put in jail, all she would have to do was turn to our daughter and say "see I told you what a ******* your dad was, putting your mum in jail". it is complicated, but I am getting fed up and am looking into pressing kidnapping charges and see if she can be extradited back so that it can be dealt with on home ground. I won't stand for this anymore, 5 years is a very very long time.
