Eight months ago I bought a condo in a 4-unit building. The selling real estate agent informed me the the building was complete and the condo was move-in ready. No one advised me to get an inspection, so I didn't. Now all sorts of problems have come up - there are no storm gutters or downspouts, nearly every window in the building leaks (even in the common areas), there is some sort of mold growing on the interior of the brick walls, etc. These are things that should have been taken care of by the developer, or certainly by the condo association, but nothing has been done. The common areas haven't even been cleaned in the past 8 months.

I was the last buyer, and the building was 75% full at the time of my purchase. My real estate agent told me that legally, the association must be turned over to the tenants within a set amount of time once the building is 75% occupied. It wasn't, and eventually the developers set up a meeting to turn over the association to the tenants. While at the meeting, we learned that the association hadn't even been formed yet (this was 5 months after my purchase)! I had been - and I still am - writing checks to a non-existent condo association! We refused to accept the responsibility for a building that still needed work, and the non-existent condo association remains under the control of the developer.

I faxed a letter to the developer a week after that meeting listing all of the problems the building had, and they verbally agreed to fix all problems on the list. It's been three months and over 30 phone calls have been placed to the developer and their contractors, but non of the work has been done. The developer does not return any phone calls. What can I/we do about this? Surely there is some law against what the developer is doing (or not doing), yes? Do we need to hire a lawyer? I'm at my wit's end with these people!
