I own a condo in a 2 unit condominium association in Massachusetts. The owners of the other unit will soon be selling their unit. There currently is not a right of first refusal in the condo docs and the other owners and I are not on the best of terms and they have said that they do not agree to adding the ROFR to the docs or will they sell the unit to me, even if I offer more then someone else. As adding the ROFR to the docs is a disagreement between the associates I know I can take it to arbitration to have that settled. What I would like to know is while this is in arbitration can the unit be blocked from being sold until the arbitration process is over, and hopefully the ROFR is in place? While I would like the ROFR going forward no matter what I would like it before the unit is currently sold so I can purchase it now.
