California Law: I married a us citizen in good faith in sept of 1997. The conditions on my residence have been removed and the marriage isn't going too well. I would very much like to apply for citizenship but I don't want to file it through her. I would like to seek a divorce but she has threatened to tell INS that she only married me to help me file for permanent residence (which is not true) if I decide to go through with the divorce. Can she do that? Will they take her word for it? Wouldn't she have to prove it? What can I do? Any advice would be greatly appreciated.

Does this mean you have your 10 year green card ? If you have proof that you entered into the marriage in good faith (copies of letters etc) then you should not have to worry about what the ex says. You can file for Cit in about 5 years and do not need her to be part of it.


Tell them they are bitter and to get over it..

Thank you. I don't have my 10 year green card. I've been married to her since sept of 1997. We filed through the I-130 and recently got my conditions removed from the permanent residence card. Do I need to wait 12 more years to file for citizenship on my own? If I file through her now, will I get it in 2 years maybe? I think I'd rather deal with her for another 2 years than to deal with INS for another 15 years. Please advise.
