I live in fl and sold my house. Now i was going to rent to improve my credit. We found a house and the guy wanted 1yrs rent up front and more deposit. We signed a lease stating that the leases was in effect April 15th or May 1st once we paid a years rent received the keys and moved in. Howere once we closed on ourhouse we did not clear enough to pay a years rent so we told them and they said ok pay more deposit and rent on the first. No new lease was drawn up and the leasing agent said she never told the owner we moved in and since he changed his mind and dose not want to rent to us we need to get out. We transfered all untilites there and transfer our son school as well. Someone told us there is no way they can make us leave now but I am not sure. Still living out of boxes!!! :rolleyes:

Its tricky, if the lease is signed it seems you can say, but it might be contingent on the fact that all the rent is paid in full. What does the lease say?

I am not sure how to reply back. I did speak to a lawyer and he said once i could not pay a year by may 1st we entered a verbal agreement but i am still not confortable with what is going o. I hate to unpack to just pack again

Its been so long since I was a new poster, I guess I forgot how tricky it must be for newbies. You do not have to hit quote each time, just the blue button on the left hand button *Post Reply*.
Trish... to tell you the truth, I feel bad you did not make any money on your home, but I would tell you to not unpack. Find another place, even though it will be inconvenient. If you are having problems already with this landlord it could last all year. That is not legal advice.

However, you are saying this was all verbal and not written? You have spoken to a lawyer and they said that you are in a verbal agreement? Did he say you have a right to stay there even if you cannot pay?

I have had more coffee, but I am still confused. I am not liking your leasing agent very much though!

Well Trish, as you can see at the bottom of my post, that is what is called my signature, I am not a lawyer. You did talk to one who said you can stay. I would see if you could get him to write the landlord a letter (you will have to pay for it though) saying he has to hold to the agreement, come up with the money on Mayday and stay.. Be a good tenant. save your money and I hope your son enjoys his new school.

Thanks for all the advise The lawyer did send them a letter stating he is representing us and they are mad. People of that nature have no idea what it is like to move a family then tell them 2 days later to move. The leasing agent sent us a letter saying she never told us to move in however if that were the case how did we get a key. What a mess

Tell them you would be more than happy to move.....

WHEN they reimburse you for all utility deposits and charges, moving expenses TO the apartment AND to the new place, return all monies so far paid AND give you $2,500 for putting up with their crap.
