Hello, I recently filed a small claim againt an individual who ran an LLC company. The individual owes me $500 for products given to him roughly one year ago and I am also seeking $1,500 in web development fees.
Here is the problem.
The individual in question has told me he recently filed for chapter 7 so I am more than welcome to go to small claims, but that I will lose.
The company had several investors, one of which was a private accounting firm.
When I would send products and invoices to the LLC company I have a claim against, I would be paid with company checks from the private accounting firm.
I would also routinely communicate with the individual who runs the accounting firm and not only did he assure me on several occassions last year via email that I would be paid, but he also said that the owner of the LLC I am suing had actually become a sub-contractor at some point earlier this year. So I am assumming the accounting firm took ownership of the LLC in question.
I added both parties to the small claim to cover any bases as I was not sure of the actual relationship.
My question is, if I was receiving past payment for invoices from the accounting firm (which is still in business) rather than the LLC (which is no longer in business), do I have any chance to recoup any of my money if this accounting firm was responsible for the LLC.
The owner of the LLC emailed me shortly after he received his small claims papers in the mail and seemed very worried about going to small claims court and offered to pay me the $500 for the products, which I thought was odd because he could just go to small claims and say there is no company.
I am assumming the gentleman who runs the accounting firm is extremely mad and worried he is somehow still responsible for this and told the guy at the LLC to try and settle???
