Consumer product safety laws and non profits

What is the name of your state (only U.S. law)? Virginia
I run a small non profit which donates handmade items to other non profit groups, hospitals and similar organizations. Some of our items are intended for children. Am I obligated to label our items with appropriate tags (i.e. Warning: choking hazard - not for children under 3 yrs)? What constitutes a 'choking hazard'?

It is nice that you are donating items that you make to children.

Not only are you obligated to comply with the marking rules, you are required to ascertain through testing that any materials (paints, etc..) used are not toxic. This is something us volunteer woodworkers have been wrestling with for several years since the regs changed.
