what are the laws regarding contacting employers when someone refuses to pay a debt? may i speak with my former boss about a fellow employee who defaulted on a loan and ask her to speak with the debtor in order to avoid small claims court?:confused:
 


I don't think you could do that unless you have some type of personal relationship that extend far beyond the work place. This could back fire in your face in small claim court for slandering. The laws does not allow the debtor to contact and employer regarding the amount of money that the employee owes. You could have paper served at their job because you did not have means to reach them any other way if you want to haul them into court. Check the FDCRA. All of your answer will be founded their.

FDCRA ? That's an Act I've never heard of...

Try the FDCPA - Fair Debt Collections Practices Act. CREDITORS or collectors are NOT allowed to discuss a DEBTOR'S debts with ANYONE unless express written permission is given by the DEBTOR. The only exceptions to that would be if the 3rd party is a spouse or legal guardian.

Keep in mind that first party collectors (as you would be) does not fall under this though. What you say can back fire on you and basically general questions is all you could ask anyway. If you are going to take it to court you can supeona records though. All depends on what you are trying to get the information for and how much is it. Is it going to be worth it, Good Luck.
