Hello, I am from Hudson, New Hampshire. I am an independant contractor for a newspaper company. However, they have not been paying me per what the contract is between myself and the company. I have too many times asked why I am being paid less then what the contract says and they avoid me!!! They treat me like I am an employee, except when it comes to paying taxes. Of course I am totally responsible for all of it! I am searching high and low for a lawyer that could have a consultation with me, because it has a lot of detail to it. If there is a lawyer in my area that could help by all means please contact me via e-mail(carignan2112@aol.com). Up to date they at least owe me $10,000. I also wanted to know what the laws are for the time limit you have to file for breach of contract, exspecially when they owe you money without a doubt?

Is there an attorney's fees provision in the contract? I ask this because even a simple breach of contract claim can run up attorney's fees quickly, and you may end up paying more than what you recover. Think from a business perspective, and consider the value of your relations with the company, long-term prospect for other contract jobs, referrals, etc. In any event, the statute of limitations for filing a claim for breach of contract, I believe can be easily found online. Just go to Google and type in --- statute of limitations breach of contract New Hampshire. I believe SOL in NH for contracts and accounts is 3 years. Not sure.

Go to the labor commissioner if you concur that you are an employee, or go to the National Labor Relations Board to see if you can join a union to represent you

John Doe purchases a truck and agrees to haul for Jane Doe under a owner operator contract that specifies that the relationship is that of owner-operator / independent contractor, not an employee.

The contract also contains other clauses including dispute resolution, non-competition, hours of operation, weekly payment, etc.

John decides he would like to join the teamsters union and be treated as an employee, notwithstanding the terms of the contract.

The National Labor Relations Board (NLRB) is charged with administrating the National Labor Relations Act (NLRA). Following a hearing, the NLRB determines that pursuant to definitions contained within the NLRA, and disregarding the terms of the contract, John Doe is a statutory employee and not an independent contractor.

What now happens to the contract? Do the other conditions within the contract remain enforceable? What are the jurisdictional limits of the NLRB?

If an action were brought under state or federal law for breech of contract or specific performance, would the local court decide it, or would it be referred back to the NLRB? Does the NLRA grant the authority to decide such issues?
