contempt hearing is over with, finally.

What is the name of your state (only U.S. law)? FL

Well my CS enforcement/contempt case is finally over! My x husband did show up. Even though the GM (general magistrate did a Show Cause and Order to Appear last month. She began with, how it was my hearing and I could proceed. I thought it was her hearing since she issued the Order to show cause and the Order to Appear.
At any rate lucky for me I was ready. The bottom line is he was found in willful contempt, had to make a purge payment, arrears was established, arrears payment was tacked on to weekly payment (the amount was impressive, I did not expect that amount), and of course if he does not pay the purge he is to serve 5 months and 29 days in jail. (he has already paid the purge)!!!
She turns to me and says this is his first contempt right? LOL, try his fourth! Which seemed to come as a surprise to him as well, but then again so did the certified paper I paid for just prior to the hearing showing his last CS payment, how much he owes as of the date of hearing, and how each payment accrued weekly.
I don't understand how one buries their head in the sand, its like covering up one finger and looking at the sun, if I can't see it, its not there. good grief!! Anyhow, I am happy its over, and he had to pay something.
BTW he was within ten miles of our son and never came over to see him, never mentioned his name, did not even ask about him. Thankfully I never told my son his dad was going to be in town, I decided not knowing he was here was better than knowing he was here and realizing he did not bother to come see him.

I am supposed to go to a contempt hearing in dec. too. and have been curious as to what will happen as this is my first time going but it may be his 2nd, 3rd, 4th? (he has other children, they have since passed the age of 18)
My case was filed by the child support agency, so all along I had assumed that the prosecutor will be the one steering. so you got a chance to speak?
I have the same situation of the father being within less than a 15-30 min drive away but never seeing the children.
Anyway, this isn't about me, lol.

You are welcome. Oh yes I got a chance to speak, I HAD to speak. In the past I would present my case the judge would apply the law, simple as that. This time, like I stated, this magistrate expected me to be an attorney, know all the case laws and present my case like an attorney, etc etc. I understand it, it was my choice to file the motion and my choice to go to court pro se. I do understand as well that the Magistrate cannot give legal advice. I was not asking her to. However, I felt like after I presented my case, I gave him enough evidence proving that the NCP was in willful contempt and had the ability to purge, however the magistrate was not convinced and said so. Wanted more from me as in proving the NCP could purge the contempt! Finally I prevailed.

Since your case was filed by the child support agency you will be represented so you can at least take comfort in that. The CSE would not represent me at this hearing and called telling me they would not.
Its quite an interesting "game" going on with the states and the federal government with regards to money and how much they get based on how much they collect in CS and how well they perform. IMO they need more stringent guidelines they must follow or they lose more of a percentage of that money. Otherwise nothing will ever change, and collecting at 50% of their cse cases, is by far no where near good enough.
Anyhow, best of luck to you, hope all works out well for you at your hearing.
