What is the name of your state? Louisiana

:confused: Right now, I'm trying to obtain help for my husband. The story is he has a child he pays cs for. Everything went well up to about 4 months ago because he bacame unemployed. He couldn't pay his whol payment but, he sent what he could. He and the mother were not on speaking terms she even blocked out our telephone number so he couldn't reach his daughter. In July he was subpoened to attend court on a contempt of court order. He went but, the judge set it off and told him to pay the ordered support and a extra 150.00 to the arrears and return to court in October. The child's mother attorney wants my husband to be jailed. The child's mother has called and told me that all she wants, is for my huband to continue spending time with his daughter, to keep working and making his payments. She stated to me that she don't want to see him go to jail. She says she understands that he was unemployed for sometime and he now has employment where he can pay and that's what she want. Doesn't she have a right to decide how she would like for her case to go. She says, she keep telling her lawyer that if he's jailed he won't be able to work and that means her child receives no cs. Please someone tell me something that could be done about this!

Contempt Of Court Order

He sends payments to her attorney who in return I guess he gives it to her.

The Judge will be the one to decide. It sounds like the Judge has given till Oct. to pay up.

A lawyer works for the client. It's the Lawyers job to represent their client as best the law allows. Often meaning the threat of jail for contempt will often force the payments to be made current .

If the client wants the Judge to consider their wishes , they need to be at court and tell the Judge out of their own mouth . The Judge may or may not allow their wishes.

The client should really make it clear to their Lawyer , what they are seeking.

The question is , why even have a Lawyer, if they are happy with the way things are in the first place ? It's just a waste of more money that could be going for the child and household expenses .

That is just what I think. I told her that she can save alot of money because this attorney charges her 500.00 every time they go to court. The attorney wants my husband to pay her fees. My husband attorney says that he won't let that happen.

Hi.Well, not in louisiana. I'm in Oregon.

My boyfriend and I are in the same situation as yourself! Only one differant thing. We have about 10,000.00 Dollars of child support that we payed. But, she did not claim it to child support. She threw my boyfriend into contempt(x4). And not even his lawyer would even look at my evedience until the last minute. and right before they were going to fry him only then did his lawyer mention what evedience we had. Still even so No One would even guide me in the right direction on how to get this stuff ajusted. FUSTRATING!!!!!!
