I am a teacher at a charter school in Ohio. As I am employed by a public school I do have an employment agreement. This agreement states:

Exhibit A Employee's duties and obligations: The company desires that he employee perform...
1. Arrive at school at 7:30 AM and leave at 4:00 PM
.....
5. Assisting with student activities (i.e. field trips, programs, spelling bees, young authors, etc...)
.....
7. Attending all Parent Teacher conferences, IEP Meetings, Staff Meetings.
10. Participating in all required training
11. Other duties assigned by supervisor

Everyday we have two meetings. One at 7:30 and one at 4:45. We are told that we need to be at school early enough to prepare for the day before the 7:30 meeting because we are not released until students begin arriving. Then our afternoon meeting consistantly runs until 4:30, 4:45, or 5:00 before we are released. This occurs on an everyday basis. Then when the time comes to fill out our time sheets to send to the state, our employer will not accept them with the correct times. Even though we are not released until 4:30 or 5:00 everyday we are forced to fill them out 7:30 to 4:00 with a 1/2 hour lunch (whether we get a lunch or not). We also have frequent weekend and afterhours required training for which our expenses are not paid.To top it off, our school is taking a 5 day trip at the end of school which we (the teachers) are required to organize and carry out. We were just informed that we are required to pay the field trip costs which would be a net loss of money. ($600 dollars per week salary- $700 dollar trip fee. Can they do this? Basically we work over our hours everyday (required) and then have to lie on our time sheets. And then the last week of school we have to pay $700 (only make 600 per week) to work the whole week. Basically I am paying my employer to work that week. Help!

What you need to do is show the ENTIRE agreement (not just what you consider to be the relevant paragraphs; you may be correct but depending on what's in the missing sections, context counts) to a local attorney. Only someone who has seen the entire agreement can say whether the employer is violating the contract or not.

The other duties and obligations consist of records keeping duties (i.e. keepng accurate attendence records, student narratives, and grade records) Nothing dealing with time afterhours obligations.

The fact remains that it would be totally irresponsible of someone to try to interprete a contract that they have not read in its entirety.
