What is the name of your state (only U.S. law)? California.
In May, 2002, we filed a Ch 7. It was discharged in August 2002.
On March 26, 2009, we filed Ch 13 (and we are still in it today). We would have qualified for a Ch 7 but it was within 8 years from the 2002 filing. I have recently been layed off and we are looking to convert the Ch 7 to a Ch 13. Since the 8 years will be up in May, 2010, can we convert or file a Ch 7 at that time?

Thanks
