What is the name of your state (only U.S. law)? New York.

Hello,

I am the shareholder of a coop building.
I had to leave for a couple of months to take care of my mother being hospitalized and I am unemployed. My cousin took my place for this time being.
The board is really threatening me to take action on Violation of Proprietary ! Can they really force me to sell ? I don't understand such no flexibility procedure ? I explained them my situation and they just care about PROCEDURE?
also a neighboor came to my cousin screaming at her, and asking her who she was ? I am totally shocked by those actions, it's unacceptable behavior between owners. What can I do ? and it's a big violation of people privacy ?

Yes. They would have to take you to court first, but if they do and the judge sides with them, you may have to sell, and potentially even be required to pay their legal fees. It's all spelled out in your proprietary lease.

Well no, it's not "procedure", it's a contract. A legally binding document where you agreed to do certain things as well as agreeing not to do other things (like give your apartment to your cousin). Since you breached it, you are now liable for the consequences. That's law, not procedure.

Actually, your breach of your proprietary lease is unacceptable behavior to the other shareholders. He was not screened nor approved by the Board to live there, but somehow you feel it's ok to not follow "procedure" because it's your cousin? Of course they're going to be angry!
What can I do ?
Kick cousin out ASAP. Beg the Board for forgiveness. Maybe offer to pay the sublet fee for the time he was there. Promise never to do it again. Hope they don't move to revoke your shares.

thanks for your reply, that is to say !!
by laws shouldn't give all rights + those are particular circumstances !! in life people need to learn flexibility ! laws are made to protect certain people and to oppress even more others !
It certainly doesn't give a right to anyone to knock on a neighboor's door ! this is worth than Inquisition time !
But I will follow some of your advice and will never buy a coop again !! they are completely out of their mind with those by-laws (+ with this economical crisis they are forcing even more people to sell or foreclosure instead of trying to work with them) welcome to FREEDOM LAND ! AND MONEY LAND !

You as a shareholder has rights and the by-laws are not the only laws that govern the co-op. You can look into laws of new york website and follow the link click on the (BSC) Buiness Coporation that should give you more insight on what they can do. Hope this was helpful for you. Wehaverights
