Hi All,

Does anyone know how to go about reducing the ordered amount of child support (self-help)? What forms should I file?

Details:

Joint legal and physical custody of my 5-year-old

I was the original petitioner for custody after my ex-girlfriend moved and disconnected her phone line (daughter was 3 at this tiem). She initiated the child support.

I have always payed child support, before and after the court ordered it; never missed a payment ( a couple of late payments, however. 1-2 weeks)

After I gained custody, the court only let me see my daughter 10 % of the time - they wanted her to get acclimated to her "new" environment after not seeing me for 3-4 months. I was imputed income by the judge because I was student. I was also charged an additional "fee" for rent because I was living with my mother at the time (even though I was paying her rent.)

It has been 2 years since this child support order had been issued and I now have 28% timeshare, I'm still a student, and I'm paying a ridiculous amount of rent for a 1 bedroom for me and my daughter.

A few issues that I want the court to hear. 1. My daughter is now in kindergarten and my ex-girlfriend insists on keeping her at a private school. She did attend a private preschool because the prices were similar to that of daycare elsewhere, but now it seems like an excessive cost, especially considering that I'm not religious, nor economically able to fund it. My ex-girlfriend is in a better financial situation than me, so she doesn't really mind paying the additional fees (or having me pay them). 2. I figure that my contribution would go down now that I have more timeshare. 3. Other custody issues (i.e. I want my daughter the Monday following her birthday weekend, which is mine, but the Monday is her mother's - Memorial Day; I also want a week in the summer)

Can anybody help guide me?

Go here. California Courts: Self-Help Center: Free and Low-Cost Legal Help: Lawyers, Government Agencies, Nonprofit Groups: Help With Particular Kinds of Problems: Family Law Facilitator in Your County

This will give you lots of info. There are also Family Law Facilitators that will help you fill out the form for a modification.

You'll need to fill out a few forms FL-300 and FL-150 - others also. Find out if your courthouse has a Family Law Facilitators office and go at the crack of dawn to have them help you fill out and file the forms. You will have to serve mom, either having a marshall do it or a friend that will sign the form.

I tried contacting the facilitators in my area (Alameda county), but I can't get through on the phone. I'll try stopping by their office.
