Brief overview...my husband had a premarital judgement against him, but had no assets beyond his disability pay and his homestead ( neither can be attached in MN). We had talked to a lawyer about selling the home, and he told us that an encumbrance would show up, and we would have to apply to the courts for an exemption, and we would have to buy a new home with the proceeds. The lawyer added my name to the deed, as joint tenancy with survivorship rights, after I had invested about 19K in a settlement with hubby's ex, and remodeling.
Fast forward...my husband passed away, and 3 days later I accepted an offer on the house....in great emotional pain and doing everything they tell a new widow not to do..not thinking clearly...I had a different lawyer for the closing, and the buyer had a lawyer, too....a squabble over a typo, but that was resolved....and the deal was closed.
Went to the first lawyer on Friday, and he said if the encumbrance didn't show up before the closing, there was nothing that the judgement could sieze....
True???? Or do I find a new laywer?
