What is the name of your state? Georgia

I had a credit card and due to the lack of work the passed several years I have been unable to pay on it. It went to two different CA's and now is with a lawyer. I received a summons that I had to pick up from the local courthouse a couple of weeks ago, but it didn't have a court date or anything on it. I do work a part time job and have for about 2yrs now, just cannot find full time work. I am married and all the bills are in my wife's name. I am considering filing bankruptcy, but will they accept this because my income isn't showing as paying any of the bills since none are in my name and don't want my wife to be involved as her credit is good and I am the only account holder on this card. Any answers would be of great help.

Sorry, this was the only way I could see to reply. I am pretty new to this junk and I AM NOT a lawyer, but if it has been several years since you made a payment, you may be past the Statute of Limitations. How long has it been?

Well it hasn't been past the SOL yet! It is 4yrs in the state of GA I know that, and it has been about 2 1/2 yrs since last payment.

*** Okay, so what EXACTLY was this summons?? Were you sued?? Have you contacted the court to find out what this summons is all about?? What did they say??

*** HUH?? If "all the bills" are in your wife's name as you state, then who's name is on this account??? Yours or hers??

*** Why??? If this is your only bill, the negative impact of your filing for bankruptcy will far exceed the discharge of this one bill. Bankruptcy is NOT to be taken lightly and will have repercussions for your wife also (increased interest, etc.).

*** Who accept what?? Are you asking if the bankruptcy court will accept your petition?? Of course they will. Are you asking if the court will grant your discharge?? No one can answer that without an extensive review of your finances.

*** Here we are again. You first talk about this credit card YOU have, and now you are saying that 'none' of the bills are in your name. Confusing to say the least.

*** Again, if this is your only debt, it is VERY unlikely that the ordeal of bankruptcy would be suitable.... or even successful.
