Update!!!

I am very happy with yesterday's outcome, the motion was dismissed but that is a good thing, the judge made it very clear to DAD that everything I presented yesterday could be presented at a later date if the need arose. DAD at one point said he would be filing for child support, the judge kinda rolled his eyes and said "that is your right, but I believe MOM has the child above the amount of time required to put her in the shared expenses formula, I think she has the child about 30% of the time." at that point I opened my parenting time tracker and told the Judge that for 2006 DAD had KIDDO 66.2% of the year and I had the remainder.

I think I prepared well because everything was rather easy.


Couple great things that tested my ability to hold in a laugh

the GAL asked DAD "Do you think your girlfriend sKELETOR afford MOM the respect she deserves as the mother of your child?"

DAD looked confused and said "I am not sure, I, what does afford mean"

GAL *sigh* "Does SKELETOR treat MOM with the respect she deserves as the mother of the child"

DAD " Well she tries.."

GAL cut him off and said, "but she doesn't quite make it does she?"



DAD also tried to really downplay SKELETOR harassing me, the Judge told him "you can believe whatever you want but I have in front of me, a complaint, charges and a conviction, it's pretty clear to me what happened"


Judge also said he doesn't think DAD understands what joint legal and physical custody means.

The big thing that the judge said was he can see clearly DAD's minimization of the Mother in KIDDO's life.

He told DAD part of the custodial parents job was to ease the path of the non-custodial parent to having a relationship with the child, and that parents who have not done so have lost custody in the past.

Back to CS- the judge said since they hadn't filed a motion they need to file a motion and he would hear it as soon as possible and at that time he would also tighten up some things in the order.

Throughout the proceedings, SKELETOR was whispering to DAD's Mom, giggling, sighing, rolling her eyes, at one point she laughed right out loud and DAD's attorney had to turn around and tell her to stop it.


I am really happy with how the day went, it reinforces to me what I thought from the beginning, sometimes it really is worth it fight a losing battle, what I got out of yesterday

The judge knows DAD's an ass
The judge knows SKELETOR is an ass
If I do file anything again, they can never say "MOM if you were so concerned about the events in 06 and 07 why in the world didn't you bring it to the courts attention then?"......
Our order should get tightened up
DAD has been told to shape up and a possible consequence of not doing so


I went into this thinking that no matter what the outcome this was a win win for me, and it did end up being so

now I have no idea what to do with myself.....I have been involved with court stuff so long, I think my life is going to feel suddenly empty LOL

hahahaha, for a second there I thought the GAL actually referred to her as skeletor!!!!

congrats.

I was going over my opening statement the night before court and had posted it on an ncm board for thoughts, of course I had the word skeletor in there....so when I read it to hubby I actually said skeletor- we both were ROTFL but definitely thought it in my best interests to insert the proper names LOL:D

Not so fast, lil missy. Between YOUR Asshat and Stupidhead and MY Asshat and Stupidhead and Majo's Stupidhead... I think we can keep the Lillith in us all busy for awhile. Especially considering how my second week in Dec is shaping up.

actually no, prior to court I was mulling over whether to make my normal request for the courtroom to be cleared, I decided it would work better for my case to have her present, she can't control herself, and I think the judge saw that yesterday

One day his X is going to use her usual threat "you want to take this back to court?"

and he is going to say "YEP".

and he will be the ultimate in prepared.

I'm preparing my statement to the court for my upcoming hearing. I do believe I'll have it ready to send out for editing/comments by end of week. It'll be a nice prep for my other court date the following week. :D

I forgot one thing, when the GAL was talking at the end she described how kiddo had said he had a great summer with me and everything was good, and then a few weeks later DAD had called her up and sounded anxious on the phone and said that kiddo was demanding an appointment with her. Dad said he didn't know why kiddo wanted to talk with her. Then she said - in court- "which I don't believe that for a second", she had him bring kiddo in and kiddo told her he never wanted to come back to my home, when she questioned him on why he couldn't give her one single reason why.

I was busy!!! I'll still send ya the questions, they were good, and I found out that if a sentence has more than one comma my ex gets totally lost and has to have it broken down into individual sentences......that was funny, I almost felt bad for him
