Pros and cons of court ordered phone visitation? The reason that this is set up is so that the non custodial parent can have *contact* with the child. Normally when the custodial parent and the non custodial parent do not live in the same area.

This is done so that the relationship between the parent and the child can exist. ie: Keep up on how the child is doing, what the child is doing, how school/daycare/camp or whatever is going.

Think of it this way....If you were a non custodial parent and only have a limited amount of visitation time, wouldn't you want to have the *option* to talk with the child on a regular basis OR if you choose to? ALOT of parents avoid telephone calls from a non custodial parent which could lead to interfering with a child/parent relationship. *IF* a parent wants to call their child, they should have that right. Therefore, phone privaledges are becoming more and more common. It's a court order, and just as if it were a normal visitation; you should always abide by that order. If the non custodial parent has the right to call the child every Saturday at 6pm, then the custodial parent has an obligation to have the child home for that call. *IF* the non custodial parent habitually does not excercise that right, the custodial parent can petition the courts to have it eliminated.

This was agreed upon by BOTH parties (phone rights).

sorry about that, have been busy transcribing phone tapes. haven't been on line as often.

i responded to your previous post for the this question. MSM laid it out straight. that was what i was trying to get across on the other post. it is a set schedule. it locks you into that day, at that time. your child has to be there and available for the call.

the post that we were referring to, the NCP did not have a court order established. he was calling every night and upset that they were not available when he called. i wanted to point out to the CP that a court ordered phone visiation would set it up, so it was this day at this time. the child could be there. NCP could "visit" and it would cut down on the hassles of the NCP being upset when he called and they were not home.

BUT...it also limits the flexibility of the CP. The CP has to have the child available at the set time. There are going to be ballgames, weekend plans, etc. As the child gets older - they will interfer with the set time. You are going to need a flexible NCP that will allow for those vacations and ballgames, who will be willing to get new contact numbers for when you are gone and calling later after the game, etc.

If that flexibility was there from the NCP, then the previous poster wouldn't have had the problem with the phone visitaion in the first place.

Phone visits are good. they are a good way for the NCP to keep up on what is happening in the life of the child. but when it starts going through the courts - the flexibilty is removed.
