What is the name of your state (only U.S. law)? Florida

I currently have a tenant in a duplex. She is Section 8 (Government Assistance) and her rent is paid entirely by the state. She has a lease which runs until July 09. She has grown increasingly mentally disturbed over the past several months. I cannot send any repair people to her unit as she has accused them of deliberately damaging her property, going through her panty drawer, stealing from her, deliberately breaking things, sexual harassment and now demands that we smell each workpersons hands, fingernails, clothing, breath and check their underware for cleansiness before they come to her unit. We had a very nice young man move into the other side of the duplex and she has now told police that he is reaching through the toilet lines and touching her shoulder. She also has said he comes through the walls at night and showers in her unit. She has now broken several windows in his unit although we cannot prove it was her. The police have been there 10 - 12 times in the past two months due to either her calls or the calls of the neighbor next door. The Realty Management Company says they can only evict her for non payment of rent, but since this is direct deposit from the state, that isn't going to happen. I have now lost the tenant in the other side of the duplex because he is concerned for his safety around her. The police cannot use the "Baker Act" to put her under mental evaluation as she does not meet the profile. Any suggestions on how to get her out of the unit? When section 8 conducts an inspection and you are unable to conduct those repairs they will stop paying her rent. You can then start the eviction process for non payment. Or, you can open up a dialogue with her section 8 office and figure out a way to evict her under their rules.

You may want to re-think ever renting from section 8 again.

Untrue. There's a whole schlew of reasons one can be evicted under section 8. You just have to be able to prove it (nonpayment is the easiest).

It sounds like this woman needs some serious help. Does she have a family member or even a case worker that you could call? The section 8 office may be able to direct you.

AL - SOMEONE has to rent to Section 8 people.

Have her watched and video taped, when you catch her destroying your property then evict her.

As long as its not you. Right?

I actually have two section 8 tenants at the moment. The key is screening who to rent to and who not to rent to. As long as you get a good tenant who takes care of the home it is guaranteed payment every month. Fortunately most around here take good care of the homes because they don't want to get kicked out and off section8 and have to start paying their own rent.
