In March of 2004, I signed on with a credit counciling group to consolidate five credit cards. I was making the minimum payments before this and all my accounts were open and current. Since signing on with the company I have made my payments each month to the counciling group but they do not seem to be applying them to my credit cards. I have called and sent letters and faxes asking for a detailed accounting of their payments (last request 11/5/04) as of today (11/22/04) I have heard nothing. They had proposals submitted and accepted by my creditors in May, but this company is out of Florida and they were affected by the hurricanes this summer. Then they apparently had a fire. (I only learned this by talking with one of their councilors when I called them). The accepted proposals expired when the company did not make the required payments and since then I have been charged late fees, over-limit fees, and high interest rates. To date these charges have added up to over $1500.00. I signed a contract with this company that states:
Cliet agrees that at no time shall PCCI,or its agents, affiliates or representatives, be liable for any losses incurred by Client, or for damages caused to Client, including any garnishment, levies, late fees, negative credit rating or repossessions, except caused by PCCI'S gross negligence or intentional acts.
Do I have any legal standing to recover the monies this organization has cost me?
