Criminal record found on ex...I may get custody

What is the name of your state? VA

I just found some 100% reliable information on my babies mother. I just may get custody if its what I think it is. I have a copy of a file from the district court - criminal division.It states as follows........personal info excluded..... Defendant status: Fugitive
Charge:CAPIASF/MAKE RESTITUTION.....??????? What does that mean? Case Type:Capias Class: 1 ..What does this all mean?

Then it has ....Hearings......Date11/03/05 Time2:00 Result: Finalized
Fine:$.00 Cost:$.00

Does this mean that nothing came of the case or what.....???
The whole fugitive thing is throwing me off.....lol All other items such as prob. time, fine paid, and sentence...are all left blank................Could all this mean they are looking for her? Her maiden name is listed on the file, not her current last name. I also have a file about her having to do with a 200$ embezzlement charge that was reduced of course and is on probation for 12 months for that. The offense date is 02/02/02 during the time my daughter was 10 months old. The file on the top of this page was dated to 7/11/02 for the offense date.

I'd like to know opinions on my chances of getting custody of my daughter armed with that info. and other facts such as me being an outstanding father.......lol.....Sorry for all the questions...this all came as a shock to me....Any and all comments and opinions welcome.

There are so many unanswered questions here. Have you had a relationship with the child? What, if any skeletons, do you have in your closet? And the list would go on and on. I'm not trying to dissuade you from getting some answers to the questions you've posed here regarding her status, or dissuade you from getting advice on custody, but it would be close to impossible for anyone here to advise you with respect to whether or not you can get custody. Their opinions might be interesting, but opinions here will not serve you if you are truly seeking opinions because you're concerned about the welfare of your child. If that is the case, your best bet would be to consult an attorney.

I have no skeletons in my closet and I have a close relationship with my daughter. If her mother is wanted like I think she is. I know I'll have no problem getting custody. I had absolutely no problem getting joint custody so I think sole custody would be no problem. I'm not trying to take her away from her mother but I would love to be able to see her alot more. I would like her mother to feel what its like to not see our child for 2 weeks out of each month.

I was looking for more along the lines of what the legal info I gave was all about. But thanks for your opinion.

I would call your local DA, find out if there is a warrant out for your ex, and while the child is in your care, call and report her... then take charge/custody...

do you have a local "TIPS" line in your state??

For starters, if you tell a judge that, s/he's not going to be amused. Second, if you don't see your child for 2 weeks of each month, it means that you *DO* see her for the other two weeks (since most months have 4 weeks, give or take a day or two). SO Mom does already know what it's like, doesn't she?

But a judge won't appreciate the vindictiveness of the comment.

It sounds that possibly she was to make restitution, didn't, so a warrent has been issued. Probably a probation violation as well. Go see a lawyer, have him to check to see if there is an active warrent. That way you can file for emergency custody once she has been arrested (it's not something you want to do on your own because it could so easily be tossed).
In addition, only $200? But 12 months probation? Keep digging, I betcha it's not the first time she has been arrested. Have you searched other counties in your area?

I wouldn't say something like that to a judge...lol As far as the 2 weeks out of each month goes....... I mean That I only get her everyother weekend fri 5:00 to sunday 6:00 and every wednesday for 2 and a half hours. so actually I only get to see her like a total of 6 days a month. I haven't checked other counties because the site only used the major cities for the search engine. But she has lived in this city for most of her life.

It actually says Charge: EMBEZZLEMENT >=$200 what ever the >= is i don't know.....looks like a sad face...LOL
What do you mean by it can easily tossed?

I called the PD and found out she does have a warrant for her arrest. I'm not sure on what to do though. I'm not an evil person.....so I don't want to go and rat on her. All I really want is to spend more time with my daughter. Maybe I can cut a deal with her ...lol
 
Ha i knew that would be said......lol I just have a bunch of thoughts swimming around my head.......I don't know what to do but I think something should be done. She's gotten away with alot of stuff already.......like keeping me away from my daughter for 8 months, missing DNA tests that where court ordered, which delayed the court date 3 months. And I've heard in the past of money missing from her family and other people, for which they blamed her but was never proven. I didn't believe she was a thief like that until now. Sounds to me like she needs help. And I'm sure her untreated bipolar doesn't help any.
 
not nervouse just a little shook up.....This was a complete shock to me.......No wonder why she doesn't want to take me back to court to try and up the child support..........she's been saying she is gonna do that for 2 months now. lol last time she took me to court for child support I ended up paying her 60 less a month. I didn't mind paying the higher child support payment until she took me to court to try and get more. I guess it pays to do your homework.
