Criminal Trespass issued by Riding Club President

I was a member of DeKalb Riding Club Arena in 2004. From what I have been told, the facilities, arena and land was donated years ago by an individual and is owned by the DeKalb Riding Club. Each year a meeting is held, new president and board members are nominated then voted in by the members. The 2004 members (which was not many by the end of the season) where unhappy with the President and Board and planned to insure they were not re-elected for 2005, but when the night for the scheduled meeting and new nominations came and everyone showed up, the meeting was cancelled. It was then held without informing the members, and the same president and board was re-elected and somehow voted in. No one knew for sure what was going on until last night. I was at the arena to let some kids ride when the chief of police pulled up. I was the only member who used the arena a few times a week throught the winter and I depend on it to train my barrel horse and work with kids in a safe environment. In 2004 I was accused of different things that I did not do and had trouble with the board and president just as everyone else did, but worse. Last night I was told by the chief of police that the president said I was trespassing because I was not a member. I told him I was and was then told that I had not renewed my membership and it was longer valid. I let him know that there had not been a meeting, membership drive or playday yet for 2005 for everyone to renew their membership. I was then informed that I was being accused of cutting the lock of the light box, leaving my horses overnight, riding after hours, and other acts which I did not do. He said the President was signing Criminal Trespass Charges on me in the morning, that I needed to leave immediately and if I returned I would be arrested. I left there and contacted a board member, explained what was going on and asked if he would allow me to renew my membership. He met me and I paid my dues. My membership is valid until October 2005. When I arrived at the Police Dept. this morning to tell them I had renewed my membership through a board member the papers had already been filed and I was told I had to sign them and that I would have to have permission from the President who filed the Criminal Trespass Warning in order to change it. I know atleast 50 people who would like to be members at this club IF the president is voted out. What can we do in order to get this done? How many people will we need? Do we need a city petition signed and if so how many signatures? Can I do anything about the false accusations? Any help you can provide will be greatly appreciated. They still have not given the awards to the members for 2004 and there are alot of very upset kids! Help!!

You're not going to like what I have to say, but let me tell you I have been involved in these horse club squabbles.

Well...let me say this.

When I see a squabble coming, I leave.

I suggest you do the same.

Unfortunately, I know this much to well. I won saddles when I was as young as 10 years old and just as I would begin to mount my horse to make a lap around the arena someone would contest my win and I would have it taken off my horse never to return! It is terrible how adults will do children! They will even compete with their own kids. The President of this particular riding club's wife, ended up being the only one to ride in her age group. She would walk the pattern, would still hit barrels and poles, and win the class. I only ran barrels but started out beating her in points so they switched the playday start time so that I would be unable to come since I had my 4D barrel races. She won the high point saddle for 2004! There is no way I would accept something for being the only one in my class when 20 kids busted their butts all year trying to win that saddle!
I know I will most likely be fighting a loosing battle, but I honestly think I find closure and solitude in knowing that I attempted to make things right by going by the book legally and never allowing myself to sink to their level. I can not tell you how many times I have put myself through something like this! It is becoming a habit! As long as I never become vengeful I have to keep trying! This just happens to be something I am unfamiliar with when it comes to the correct legal steps that I need to take. So if you can give me any advice I really would appreciate it.

The issue is not who is president, but the criminal trespass charge you are facing. He will have to show that you had no legal right to be there when you were. If you can show that you are a member, and that you had a legal right to be there because you were a member (bring rules, regulations, etc.), you might be able to beat the rap.

The part about the riding club ... well, you'll have to review the rules and regulations for the organization to figure that one out.

I've seen this happen approximately 63,401 times. Face it, horse people are crazy. I know. I are one.

Well my search for a current or even previous copy of the DeKalb Riding Club By-Laws was unsuccesful. Not only is there no one with a copy, but so far no one has ever seen a copy or heard of there being any. Without them there are no rules or regulations for this riding club! I am a member of a large barrel racing association who will possibly hold 1-3 of their yearly barrel races at this arena! With the Criminal Trespass Warning in affect I would have to miss them and if there are 3 held there, missing them would make me ineligable for year end awards! (Last year I won a saddle!!!). I believe my next step will be to file some sort of Request (I prefer "DEMAND" but..) for them to produce a copy of the By-Laws, Request to produce evidence to support the allegations made against me, and last but not least a Request to have the allegations removed and for my membership rights to be reinstated. Sound o.k.?

There is always the "appeal to the pocketbook" ... if they are a tax exempt corporation or other organization, they MUST have by-laws. If they cannot produce such a document, then you can always threaten to provide this information to the powers-that-be and they could face a loss of their tax exempt status.

Just curious, as noone else brought it up. I presume your dues are yearly, yet your membership is only good until October. Was your renewal actually due in 10/2004?

This part no one knows for certain. The last Playday was held in October if I remember correctly. I was at the last Playday for 2004 and there was no mention of renewing memberships for 2005. Normally memberships are good for the show season and into the winter months, then renewed the next season either at a meeting (which all members are notified of by mail), or most of the time the first show for the year is considered to be a membership drive and they incourage everyone purchase a membership at that time. Most memberships include the option of purchasing a key for an additional fee in order to unlock the gate to the club grounds so members can use the arena. This particular club does not have a locked gate. Unfortunately, this makes the arena accessible to anyone member or not. It also leads to situations such as this! Not to mention the reduction in memberships purchased. I just finished typing a Request for Production of Documents and Things requesting they submitt a copy of the by-laws for 2004 and 2005, minutes from the meeting to elect and vote for 2005 board, president, etc., list of members for each year 1980 thru 2005 and members whose dues are paid for 2005, and all documents and/or statements relating to allegations by president and the riding club in order to obtain the Criminal Trespass Warning Letter against me. Maybe this will do some good, if not, guess I will file suit against them. Thank you for the bit of information concerning non-profit organizations and ByLaws!

It has been awhile since I was online so I would like to catch you up on this situation. I prepared a letter asking that the Criminal Trespass Warning be dropped and my membership status reinstated. I delivered a copy of the letter to the 2 parties responsible for this mess. I also gave a copy to the man who accepted my money to renew my membership and to a couple of other past club members. The man who took the money to renew my membership still feels they are wrong for doing this to me and is supportive of my attempt to do something about it BUT he refunded the money for my membership and told me they would not accept it. I asked in the letter that they take care of this by a specific date, explained why I felt they were unjustified in their actions, and explained that if the charges were not dropped I would be forced to file a civil suit against them. The deadline has now come and gone and they did not do what was asked of them even though they were told by a member that they know for a fact I was not responsible for the things which I am being accused. I plan to file a civil suit which will include possible criminal charges against them within the week. I really thought it would not come to this but I really have no choice. What do you think? A member also asked them for a copy of the by-laws and was told that they do have by-laws but that they are only available to board members!

Here it is April and this riding club has still not given those kids their awards from last year! The presidents wife has her high point saddle though! I was at the court house again yesterday and found out the taxes have not been paid since this man took over as president, now they are past due. The arena looks terrible! It will have to be mowed before they can drag it! This whole situation is ridiculous.
