cs modified ex quit work

What is the name of your state? TN my ex has paid minimal cs 13 years 400/mth in june the kids (2) got modification to increase to 1100/mth (state guideline) he quit his job (of 10 years) two week later. Now he has requested modification due to the fact he is unemployed. Can he really do this. :eek:

He can try, but he is likely to get hammered by the judge. Its going to be sooooo obvious that he is playing games.
 
I'm not sure, but when you find out - let me know. My ex has paid 260/month for 6 yrs, I took him to court for modification, and is now ordered to pay 730/month. He said he is going for custody and if he doesn't get it, he will quit his job.
 
these fathers threaten to quit their jobs to prevent them from paying more child support or paying period...WHATEVER!!! if there is a court order and they quit, the amount will just accumulate and eventually they will have to pay. i don't know why fathers do this to their kids, they think that it'll hurt their ex's by doing such stupid things, but in the end it hurts their children. :eek:

I agree with LdiJ - he can try, it's going to depend on what the Judge thinks and his reasons WHY he decided to quit his job of 10 years.

I don't know why judges are so generous in awarding CS.....$260 to $700 or $1100. Jeeez, I work at what is generally considered the best job in my little corner of the world and my wife and 4 kids get by on less than $1500 a month. If CP needs that much in CS, maybe she should hand over custody to NCP!

Child support wouldn't increase that much unless the ncp's income had increased accordingly. A CP doesn't ask for a specific amount of child support and in fact has no input into how much is ordered. The calculations are done based on the state's guidelines.
 
it's a good thing that the CP can modify a support order due to either the NCP's increase in income or to the growing expences that come with growing children. if the two parents were still together raising their child/children they would benefit from the financial gains, so why should it be any different because the two bio parents aren't together. makes sense doesn't it?? :rolleyes:

ummmm...no it does not actually.....the reality of most situations is this....NCP is poverty striken because most custody/CS battles are by far biased for the mom....good dad pays CS but has no chance at normal life or other children because he can't afford the same lifestyle while paying CS which is probably set unreasonably high in the first place. So dad gets lucky break...goes to school and gets better job only tohave CS increase accordingly, tio be in same boat. All of which could have been alleviated if dad had got custody in the first place....but that rarely happens. And when it does and dad does finally get custody and tries to get CS from ex....well, lets just say I've been there. Te judge upheld her right to stay home with babies from new husband and I got no CS.....anyone who says the courts treat male and female Cp/Ncp the same is blowing smoke. Once CS is set it should stay the same. But thats just my opinion.....i could be wrong......NOT!

Audster that seems like a general statement. My ex was ordered to pay a whopping 300$ a month for 3 kids and you think that it should stay the same? As kids get older there expenses become more. Plus my child support order was done while the fathers income was from part time work so when he gets a full time job making good money my kids should still have to live off a that tiny amount? 100 dollars a month per kid doesnt even cover school lunches! I agree that a lot of CP get greedy and turn the tables to get whatever amount they can but some of us just want the father to provide something for the kids. And from your other post you sound like a loving father who yes may have gotten jerked around by the legal system based on gender but dont make it sound like every CP is out for blood or in this case money. Some of us would just like the NCP to act like a parent to put there kids above everything else as we do on a daily basis and to help provide the basic needs of there children

The best job? I was earning that amount working at sporting goods store during college in the early 80s.

If you failed to notice, the OP has been receiving the same $400/month child support for 13 years. The dad was paying way under the guidelines for many years. $1100/month means dad is making way more than $3000/month.

audster......So if you get a better paying job you will still give your wife and 4 kids only 1500 a month I suppose and keep the rest for yourself. If my ex was the kind of father he should be he would want his first to childrens lifestyle to improve along with his. I did not initiate the modification the state handles my kids childsupport, it is held out of his check because he would not pay anyother way. Also he has not even seen or bothered to call his children in over 6 months, because in his words he has his new family to take care of and my children have a stepfather to take care them. (which he does) So if he could not afford 4 children he should have considered that when he decided to have more kids.


PS It was two years after our divorce before he ever visted with his kids and I have never tried to stop him from seeing them. I would not put that kind of hurt on my childrens face

See, this is the problem with trying to use your one situation and painting every other one with the same brush. I could paint the exact opposite picture for you. Does that make all NCPs selfish and vindictive? Uuuuh, no. So, audie, how about you quit stereotyping everyone by your experience, eh?
