CS/ School/ Temp order

What is the name of your state? Indiana
At the moment I have a temp order for visitation and CS in place From june 4th. Our court date for a more perm order was set for Sept. 27th but was canceled due to the judge being ill. The new court date is set for Jan 3rd. I know that the children's father is going to be quitting his high paying job to return to school in January. Is this going to effect the amount of CS he is required to pay. ATM he is paying $50 a week per child in CS. From the financial Dec. My lawyer received he would have had the CS increased to 1,200 a month at the September 27th hearing and more likely than not be responsible for a portion of my legal bills. Will his schooling play a factor? I wanted to ask here because my legal bills are becoming out of this world.

There is no guarantee that he would have had to pay any of your legal bills. YOu need to figure out a way of paying them on your own. As for child support, if he quits his job then that is a voluntary unemployment and he will very likely be imputed with what he was making. Just one question, what is he going to school for?

I've payed every bit of the legal bills and have been putting aside some for future issues. He decided to go from a District Manager for an auto chain and owning his own car shop to wanting to become a Doctor.His new wife is in pharmacy school. He has 6 yrs of school ahead of him.

Consider this for a moment. As a District manager how much is he going to earn tops? 100k if he is extremely lucky? As a doctor how much is he likely to earn? 300k or more? NOw think about this for a bit. How old is your child with him? If young, and you take a lower child support now you will most likely get a larger child support then. If you impute him now you may cripple him from earning a higher salary and thus paying you higher child support in the future. This is also a case where you might want to make a deal such as court ordered college or what not in exchange for not preventing him from becoming a doctor. What kind of undergrad degree does he have? Are you sure he only has SIX years to become a doctor?

Our Children are 7 and 5. Well I seriously doubt he will agree to anything seeing as how he told me he would never pay me a dime of support. Although the courts told him he would most deffinatly be paying me. He just started paying after 4 years of being seperated.(no divorce needed the marrige was never legal, huge mess) Yes, it took me that long to finaly pin him down. In fact the only reason I have gotten this far is because his new wife refused to marry him unless he took care of his responsibilities. He isn't moving around like he used to and changing jobs due to his new wife. The reason we are on a temp order now is because he was about to get married and needed money to pay for his wedding and decided to challenge the paternity of the children in front of the judge even after our lawyers had talked out all the terms prior.He stated that it was so that later on I COULDN'T SAY THE KIDS WEREN'T HIS. (DNA tests came back in Beg of August. 99.99999 and 99.99995) One last note this will be his 3rd trip to University where in totally he has only earned 2 credit hours.he might go as long as he can if it will allow him minimal payment... So if he finishes... that would be great!!! Money gets him motivated!! But out of past track record he is trying to hold off paying will probley quit school and force me to have to take him back to court. In past he has tried to take vollentary demotions to avoid CS payments and when he found out that wouldn't get him out of it he would move. Last time thats when he decided to open a shop and work for cash. That didn't go over to well so he went back to one of his old employers. Also in the state of Alabama where he resides now general practice doctors are lucky to make 150,000 a year If they are verrrry lucky
