My step daughter has a custody hearing soon in family court.The background,this 30 something yr old unmarried couple seperated Oct 2005,he has anger,drug and alcohol issues and is currently seeking help for depression.She initiated the court proceedings for child support with help from the county services.Paternity and residential verifications have been made.
They have 2 boys (1 and 2 yrs old),they live with mother,father has moved back in with his mother.Childs father (cf) works fulltime,childs mother (cm) works partime,(cf) has stopped giving financial support for the boys and rarely visits the boys and does not return phone calls.
They went to mediation,they (cf) were unable to reach an agreement.The mediater has issued a report of the facts told to him,reccomendations and reasons for the reccomendations,it is the only glimpse of intelligence and common sense that I have seen concerning this whole mess.
He reccomends,the children stay at the mothers house,she has no less than 90%,he no more than 10% physical custody ,50-50 legal custody,a supervised visitation schedule for him,split holiday schedule,parenting classes for both,him to continue rehabbing.
His (his mothers lawyer) response (countersue?)was that he wants 50-50 physical custody,and orders to enroll children in low cost daycare and "impute her income to zero",stop harrassing his mother (telephone calls to her residence),keep the last name (his)as is,consolidate case #'s as they address same parties.
I also noticed within these forms a request for the cm to pay 50% of lawyer fees .
My feeling on this is that I trust the Judges decision on the wellfare of the children.
I think the rest of the stuff is irrevelent and frivolous at this time and should be thrown out of court,butI am not a lawyer,so my questions......
Does she need a lawyer or just a consultation?
Can she respond verbally to the "stay away"order concerning harrassement?
What "bad legal things" could happen to her here?
Will they address everything at this hearing?
What normally happens?
When will this end?

Well,she now has a lawyer and we will all get a day off from work to go to court (for moral support).Oh joy.
I guess there was no other option for her,hopefully something good will come out of this and there will not be a trailer in the childrens future.:rolleyes:
