What is the name of your state? GA

My ex and I never really established custody of our two daughters. There live with her, the oldest one says she wants to come with me but the youngeest says she really doesn't care who she lives with. I am in the military here in GA and they are in PA. I need to know how to go about geting first joint custody or can I go straight into sole-custody? I've been searching for answers for about a year now. someone help :confused:

You are going to need to go to Pa. to file for visitation/custody of your children since that is where they reside. I'm guessing that Pa. is your home of record. I'm the CP of my children living in Ga. and I still have to go through the PA. court since that is my home of record. It's a pain in the butt. Good Luck! Rock of the Marne!

Your original divorce decree does not state anything at all as far as custody? If not, how the heck did that happen?!?! Get your divorce decree out and read it carefully, there has to be a paragraph in it pertaining to custody.

To modify the custody you will have to go back to the courts that handled the divorce. The children may live in PA but PA does not have jurisdiction over it unless your ex wife has gone through all the legal channels necessary for the state to take over the issue.

You need to call the county clerk in the county the divorce actually took place and ask her what you need to do to have jurisdiction changed to the children's home state. Also, come back and post exactly what your divorce decree states regarding custody and visitation.
