Officer checks gun in fatal shooting in Queens early yesterday in which estranged couple fought over daughter.
An estranged couple booted from a Queens bar for brawling over their 6-year-old daughter took their fight to the woman's apartment, where her brother allegedly shot the dad dead early yesterday, police sources said.
The brother, Juan Carlos Duque, 31, also allegedly wounded two of the man's friends about 4:50 a.m. yesterday before he and his sister, Sulay Duque, 25, sped from the bloody scene in a white minivan.
"He wanted his daughter back," said Karen Bunch, 23, grieving over the slaying of her brother, Boris Bunch, 28.
Relatives said Boris Bunch, a parking attendant in Manhattan and native of Colombia, had custody of the couple's daughter, Sheily.
The little girl, now staying with relatives, had lived with Bunch after Bunch and Duque separated more than a year ago.
Bunch would let Sheily visit Duque, but the last visit brought drama.
"[Duque] wouldn't give her back for three days," the sister said.
The battling couple met late Sunday at Sarabanda, a club on 37th Ave. in Long Island City.
Bunch and Duque, who didn't arrive together, tossed back several drinks and began arguing, sources said.
At one point it got physical, prompting a manager to kick them out.
"Come back to my apartment and we'll settle it," Duque told Bunch, according to a police source.
Bunch followed her home, and the argument resumed in Duque's apartment at 83-09 31st Ave. in East Elmhurst.
Juan Carlos Duque was already there.
"He kind of had to defend his sister, and when push came to shove, shots were fired," a law enforcement source said, adding that the shooting appeared spontaneous.
Bunch was shot in the chest and died at Elmhurst Hospital Center.
Two of his friends, who had followed him from the club to the apartment, also were shot and are recovering at the same hospital.
Hugo Rodriguez, 29, was shot once in each leg. Patricia Canarte, 25, was shot in the leg.
Canarte ran from the apartment, screaming at onlookers to stop the white Dodge Caravan, witnesses said.
Patrol officers spotted the van, driven by Sulay Duque, at 86th St. and 25th Ave.
They nabbed the Duques and recovered a .40-caliber handgun.
A law enforcement source said the brother and sister were being questioned late yesterday and that charges were pending.
