day care expenese when children are not in daycare

my kids live in colorado, i live in maine i just finshed up with my visitations for the month of july. My child support is 110.00 per week and 55.00per week for daycare expenses. my ex moved from one town to another in may, which is a far enough move for them to have to change daycare. i assumed they were going,(i also payed the daycare expenses while they were with me because she said she would have to continue to pay even if they weren't going or she would lose her place) turns out since they moved in may till next week they have not been enrolled in any day care program. her unemployed live in boyfriend has been watching them..
my question is can i file something for remibursement for the time they have not be enrolled in a daycare? if so what contempt?small claims?

Is the daycare part of the child support order? Or is a separate item that you pay directly rather than through the CS agency? If its part of the order then you have to continue to pay it and request a child support modification. Otherwise you will rack up arrears. As far as getting a refund for any period that the children weren't in daycare...that all depends on the judge, and on your ability to collect from the mother.

the day care expenses are included on the child support worksheet....

also she is court ordered to show all her expenses for the year by feburary of the following year, so if the word of a young child isn't enough that statement will show a gap in her paying.

also i've emailed her twice asking the name of the new day are funny she won't answer!
