What is the name of your state? PA

:confused: my employer will not approve requests for time off (only talking a day here) if there is not sufficient accrued vacation or personal time. There is no written policy stating this. How can this be enforced? What option do I have?

Here is a clue. Go ask your employer. Half the posts in this forum is folks wanting a legal opinion of gossip heard through the grapevine. Go get the facts then come back if you have a legal question.

Employers are not required to have written policies, and they are not required to offer paid time off at all.

Just because a policy isn't written down doesn't mean it isn't enforceable. And, obviously, since you know about this particular "policy," it is well communicated.

Your options are:

1. Work because your day off will not be approved.
2. Take the day off without permission and subject yourself to the employer's disciplinary action, which could very possibly be termination of your employment.
3. Quit and get another job with time off policies more to your liking.

Employers are not required to provide paid time off, and employers are allowed to set the work schedules and work rules for their staff, so if your employer doesn't want to allow you time off, they don't have to. They don't even have to approve requests for time off if you have paid time to take.

Why would your employer grant you a day off if you haven't earned it? They don't have to offer paid vacation or paid time off in the first place and they certainly don't have to give you time off if you aren't due any under their vacation/PTO policy.

So I dont' have the right to choose to take a day off with out pay? My Boss would not care either way however the Policy police would.

Your employer dictates your work schedule. If they won't approve your request for a day off, whether paid or unpaid, then that's it.

Nobody will force you to show up at work on that day (or any other day.) If you exercise your option to be absent, you can anticipate your employer will exercise their right to take disciplinary action.
