Dead Beat Dad Appealed Full Custody Order!!!!

What is the name of your state? Custody jurisdiction is in NY, We live in GA

I knew it wouldn't be over. After I filed for full custody of my children in NY, and won, today I get a notice of appeal in the mail from the dead beat dad who is in jail right now for abusing my children! After I spent thousands of dollars in plane fare going back and forth to NY from Georgia, I can not afford a lawyer, or any more trips to NY for this. He is in jail, and has not been in compliance with social service to get anger management, parenting classes, or drug and alcohol treatment in order to even visit the children! He has no where for them to go, and they will go to foster care if this court order is over turned. He is trying to disrupt my buys life and continue to put me in a financial bind. I am already supporting them ALONE, with no help from him. Legal aid wont help me because I make too much (yeah right)! What can I do? can I file for jurisdiction of custody to be moved to GA? Should I refile for custody in Georgia? Change of venue? The grounds for the appeal says the judge misapplication of law? There was a home study done of my home through DSS and they didn't have the actual report back in time to NY, but the judge spoke to the administrator of Georgia DSS and he said we passed the home study. What could it be? Will I have to travel to NY again? Sorry for the 900 questions, I am LIVID!!!! :mad:

Is he still in NY (though incarcerated)?

Typically if one parent remains in the original jurisdiction, then jurisdiction will remain in that state. I think you should call an attorney in NY and find out if that's true if the person is incarcerated.

Also, how long will he be in prison?

How is he a deadbeat? Because he's pissing you off?

The way you bitter, angry women sling insults around -- especially this term -- is nothing less than hysterical.

Here's an idea: look up the definition of "deadbeat dad".

Isn't it ironic ? An incarcerated individual is given Free council to represent him/her .

You will really need an attorney to represent you in NY .

Procedures have to be fallowed.

In my case ( and I'm a male ) in NY , arguments were made by briefs only .
The Parties did not appear.

Perhaps you can hire a NY attorney to file a brief with the appellate Division .

This has to be done by procedure and in a timely manner .

Just think , when if the appellate Division upholds the lower court's ruling how happy you will be .
 
Thank you all for your positivitey, as for you some dude, he is a deadbeat because he sexually abused my children. So why don't you look that definition up of what that entails. You men get so defensive about that, believe me, the name comes with the fact that my children will be forever traumatized, by what he has done. So you may need some anger management yourself buddy!

I realize that you are in a serious financial bind but you really do need to contact an attorney, because you honestly don't have enough time available to you to learn how to write the necessary brief.

While its highly possible that he would simply lose the appeal, even if you didn't respond it would just be too risky not to respond.

:rolleyes: azzhole who probably has been called a deadbeat before and now is being cruel to women when he don't have a damn clue about their situation. Walk a mile in our shoes and THEN you will know what a dead beat dad is. UNTIL THEN you don't have any right to judge us just beause we consider the father of our children as a "DEAD BEAT DAD". By the way there are many "DEAD BEAT MOMS" also!!

exactly, I'd say a father or mother who never bothered to see their child and was never there for him/her is more of a deadbeat than someone that can't afford or willingly refuses to pay child support ;)

vivarantthang's ex is by definition a "deadbeat dad" and then some. He fails to provide financial support. It also sounds like he is fails to provide in many different ways. There are some children better off without these types.

I didn't define "deadbeat mom" because it wasn't suggested by somedude.

"emotional support and love" is also not the argument.

Fun Exercise. Go to Google... type "define: deadbeat dad" and hit the search button.

Ok...maybe mom didn't use the right terminology...however does that honestly make her post any less serious? Obviously there are major fitness issues where dad is concerned. Does no one care to address that...or is the only issue the fact that she doesn't understand what "deadbeat" means?

Why is he allowed to waste space on this website when we all have genuine pressing legal issues to address. Real mature. Isn't there a administrator he can be reported too? This is rediculous.
