New York State.

I bought a car from a dealership, I told them I was selling my current car to my boyfriend for 3000 dollars, the car still had 3150 left on it they said they would pay off the remainder. So I ran the 3000 up to them the next day and they said ok they will pay the rest off. 2 weeks go by and I get a call from the dealership saying they are having a hard time getting my new car financed and that i have to go back up their. I arrive and they fix the problem they get me a loan. In the following weeks i received over 20 applications for a loans that were all denied(affecting my credit). Then 2 months after buying the car I get a call that I have not made a car payment on my old car. They failed to pay it. I called the dealership they said there was a mix up and told me to come up there and get the money and take it to another place. now that loan was 3500 but they still paid the difference. 3 months after buying the car I get a letter from the bank stating they do not have my title and I need to get this to them. I call the dealership they say they will take care of it. 4 months later I still have no pink slip and no registration. I contact the better business bureau and file this report. The dealership calls me back 2 days later and tell me they never had a title for the car they were working on trying to get but it has a lean so they cant get it. Is there a case here for destroying my credit having my report ran multiple times knowing banks would not give a loan for a car with a lean. Also failing to pay off my old car? I dont know if they lied to the bank and told them there was no lean on it but somehow they got me a 15k loan. I told them I do not want this car anymore they agreed to buy it back off me. I am so pissed and I dont know if i can even get another loan with what they did to my credit. I just cant deal with these guys anymore.

Did you sign a waiver or otherwise give them permission to try and find you a loan? It's not their fault that you were getting rejected for loans. Besides, even if you did have a potential case here, in order for it to be successful you would have to prove that their actions lowered your credit score enough that you suffered a provable hardship due to the low credit.

Yes there was a contract they would find a loan for me but at no time did they tell me they did not have the title because it has a lien on it. Of course banks are going to reject that loan because of the lien. Plus the 2 missed car payments on my old car. Its been 4 months and they still don't have the title and I have called them over 10 times about getting me my paper work and they always said they were behind in it because of a huge sale. If I cant get a loan for a new car because of this mess to my credit would that be a hardship?

It could be, but you would not be able to retrieve damages without the representation of an attorney (read: you can't do it by yourself). That being said, the best advice that can be given is: get an attorney. Many attorneys will offer free/cheap consultations, so you should take advantage of this and sit down with a couple to see what insight they may have to offer.

I don't think the credit hit claim will go anywhere, but if you still don't have a valid title to the "new" car, then that's actionable. Easiest way it to file a complaint with the NY Attorney General Consumer Frauds Department (google it for a copy of the claim form).

Well the dealership refuses to pay me back my payments I already made they will only pay off the car. I contacted a detective and explained the story he said the dealership defiantly broke one law which was something covered under the lemon law. A dealership can not have a car on the lot with a lien on it unless they have two lots and one of the lots hold only cars with liens. The second one is he asked me if the car was salvaged I said not to my knowledge, he said the car could have been salvaged and if they did not notify me that it was then they also broke a second law. He took my VIN pictures of my car and he is going to find out where the car came from.

Might as well file a complaint with the AG anyway. It's free and worst than can happen is they are not successful, which leaves you in no worse condition than you are now.
