While still incarcerated for physically abusing our children, their father told his caseworker that he was going to have me killed and no one would know he had done it. His case worker informed me of this 2 months later. She called me on the phone and emailed a statement saying this is what he said to her. She also typed a letter igned and notarized it. I have filed a petition with the court to modify the visitation order to reflect their dad not getting any. Is it likely this will be thrown out because this is hear say? I live in GA, but the jurisdiction of this case is in N.Y. Is this enough to terminate his parental rights? I left the state of NY because of his violence, but I have no police reports to support this. All I have is this notarized statement from his caseworker saying he made the threat. Is this enough to change jurisdiction from NY to GA? I also asked the judge for a confidentiality order to keep my address & phone# from their father, why would she deny this?

He is out of jail and the judge gave him supervised visitation rights for every Spring break and summer and alternating holiday's. I don't want to be in violation of the court order so I am trying to get this done before summer break.

I would think since it came from a case worker then it might carry some weight. It's impossible for any of us to say though. You should also ask for a restraining order while you're at it. I'm just shocked that the case worker waited 2 months to inform you of a death threat. She should have reported it to the police.

There has to be SOMETHING missing from this story that is very pertinent. Exactly what kind of case worker are you talking about? Why would this case worker NOT have reported this threat to the police? Is this case worker not a mandated reporter?

The caseworker said the reason she waited so long was because she didn't feel he was a threat while he still in jail, she told me 2 weeks before he was released. Plus she had to make sure there was no client privledge violation before she shared this information.

If he is on Parole , notify the PO , and send him/her a copy of the Letter . Probation/Parole does not take threats lightly .

Otherwise , as a Police officer told me , on one our X neighbors , there is no law preventing someone from making a threat . I guess they have to carry it out first ?? I did tell the Police they were nuts , they hadn't even left from our original call when the neighbors knocked on the door with the threat .

I said I'd knock their &8@33$ heads off ( 2 drunks ).

Something funny two was the cops said we invited them in when we opened the door . We thought it was the cops knocking before they left on the original call .

I'm not sure you'd find anything here to Start ,since it was military , and this link is for State Prisoners /Inmates .
