I received a notice in the mail for a debt from a Jeweler that my husband once owed before we were married. I thought that we had paid this off when we bought our 1st home 4 years ago...but not sure. I have an old credit report that was pulled from TransUnion back in 2002 and this creditor/Jewler stated that we had an open account that was paid off in 5/1995 - Balance was 0.00 most owed 0 and stated as 'never paid late'.
Now it's 13 years later, obviously a collections company bought some bad debt and is trying to collect on it. They sent us a letter stating that we have 30 days to request validation of the debt or judgment. The current balance is over 1000.00. I'm quite sure that my husband never owed this much.
The account was opened in 8/1992 and paid off in 5/1995. It is a relvolving charge account. What are the statue of limitations for Virginia? I want to get this resolved as soon as possible without any negative impact.

SOL in Virginia for an open account is 3 years. Send them a C & D letter RRR certified mail explaining this to them. You can find an example at the link below.

Thanks for the reply to my question. So sending a cease and desist letter is what I should do? Can they still add this to my husband's credit report? Can't I just show the credit reporting agency that this must be false since I have an older copy of credit report showing positive account information for this account?

Yes, you should definitely send the C&D letter. No, they can't add it to your husband's credit report. You can dispute this with the Credit Bureaus, but that won't stop the CA from trying to collect or seeking a judgement. You probably want to get copies of your current CR from all three CBs too.
