What is the name of your state? PA

I live in a 26 unit building whis has four levels. The three non-ground levels have decks. My condo is on the top level and has a large partially covered deck.

The condo docs define all decks as limited common elements and t5hat all repair is the responsibility of the unit owner.

Since the deck is exposed to rain and snow water and snow have caused damage over the years. The deck now has soft spots and damage to the underlying support beams causing the ceiling to sag on the covered deck directly below.

The declaration defines the title line of a unit as being the upper surface of the concrete and/or wood floor. The management company has stated I am responsible for all repairs. That conclusion was reached without anyone inspecting my unit. They only looked at the deck below .

Who is responsible for repair to the damaged support beams and wood slabs?

A: The underlying support beams are there to create the floor surface of YOUR deck. If your deck was not there the condo below would still have a deck, it just wouldn't be "covered"

I agree with the Association, it's your problem.

Food for thought , in what condtion is the decking of the unit under yours ? If they too will have to replace part of what they own perhaps one contractor will give you both a good deal to get both jobs . Also you may wish to talk with your citys inspections unit because your city could even have allready addressed the issue and might order the whole thing to be rebuilt affecting all of you . Do you know if your HOA had been given notice by your city or county govt to have this work done or not ? its public info so your local govt will have to tell you .
