We hired a homebuilder to build our dream home. He failed to use a moisture/vapor barrier under our home as required by code and now we have moldy and damp carpets, ruined hardwoods and a sick child. We are expecting another baby and the industrial hygenist and the doctor said we should move out of our home. Even though a warranty came with the house the builder refuses to do anything. We are moving into a rent home and will have to pay monthly rent and a mortgage. What are my legal rights? I signed an arbitration clause and have tried to get an arbitration date through the Homebuilder's Association and the Better Business Bureau but was not granted an opportunity to arbitrate.

**A: you need to hire a good construction defect litigation attorney. And preferably one who has experience in toxic mold litigation cases.

Do not wait for nor expect anything more than stall and delay from Homeowners and BBB. Then, if they do happen to do anything for you it will be a pleasant surprise.
