Have posted this befor but new developments have me asking again. i live in n.c. While hunting, my sons shotgun exploded in his hands while UNLOADING IT. My son recevied burns and metal fragments in his arm. I found a attorney in LA. to look into this matter the firearm mfg. said it was not their guns fault it was the ammo. the ammo co. said no way could it have been the shells. we sent the gun to an expert, he could not give a certian cause because some fragments were blowen out of the gun and i have not been able to find them. however he did give an oppion as to what happened. something let a shell it the tube go striking something causing it to discharge which in turn caused three more shells to discharge. the attorney felt that since my son was not seriously injured it was not worth his time to try and file suite. I am out of pocket $1200.00 in med. shiping this gun every where ,gun expert and such. The way I read the n.c. law on defective firearms it is up to me to prove the gun was defective. the gun mfg. is in MASS. can i file small claims in n.c. since they do bussiness in this state? or should I take my losses and let the gun mfg. know that i have the gun and if i ever hear of this happning again i would be free to offer my gun also to show they have a problem?
would like to hear from I AM ALWAYS LIABLE on this.
