Insurance company is offering $1000 for a broad release ... plaintiff is comfortable signing that release ...so defense attorney is threatening that he will bring motion to dismiss ....Which is fine with ......plaintiff would rather not take $1000 instead of signing the release...

What he is worried about ....attorney fees and or cost...

so if defense brings motion to dismiss ...can defense attorney(insurance company) ask for fees and costs and if he can....will judge award it ?

Only wrong thing on plaintiff side -...that he does not want to sign release

Your post as written makes no sense. It would have been better if you added these questions to your related thread for context though.

No one can predict what the defense attorney will do or what a judge will do.
