Veronica, it doesn't matter if it's his phone also or not. He still must be a party to the conversation in order to record it.

You really don't have much to worry about. Even if he were to be able to prove adultery through legal means, that's only pertinent to your divorce, not to the custody issue. If the fault he cited in the divorce was something like drug dealer or pedophile, then I can see custody being affected, but I doubt adultery would have any effect on the decision about custody.

Just stay up front with your lawyer so he isn't blind-sided by anything and you should be fine.
