Did Not Receive Monies from Trust as Described

I was made a beneficiary in my family's trust where I was to receive 1/2 at the age of 21 and the remaing 1/2 at the age of thirty. I am 27 now and have not received what was described in the trust.

I have requested accounting from the trustee only to be told that the trust is closed, the funds have been dispersed and the accounting has been destroyed. I have all documents pertaining the the will and trust as well as coorspondance with the trustee regarding this.

I need assistance in getting what I was supossed to receive and I have no clue where to begin. Any assistance would be much appreciated!

My response:

Sounds like there could be a severe breach of the fiduciary duty. Who was handling the Trust; e.g., an attorney?

You'll need to consult with an attorney specializing in Trusts to determine if there was such a "breach". However, in the absence of fraud, you may run into a "statute of limitations" problem that could keep you from making your claims. This should have been investigated by you years ago because you knew that you hadn't received your funds on your 21st birthday, or soon thereafter.

I just was made aware of the trust in December if 2002. It took me this long to gather evidence of the trust and to requests accounting.

My Aunt was/is Trustee. My sister is in the same circumstance I am in as well and she turned 22.

You have posted this situation before (back on February 14) and received replies about your situation. Have you consulted with a trust attorney at all (since the time you received replies about this matter) to find out what steps you should be taking? What good does it do for anyone on this board to reply to you when you appear not to follow up with any action?

Can you afford the thousands of dollars in upfront legal expenses it is going to cost to retain a trust attorney to represent you in this matter?

Good catch, Dandy, and you're absolutely correct - - it does no good when a writer fails or refuses to take the suggested actions.
