What is the name of your state? California

If an employee does substandard work, does an employer have the right to assign the employee to go back and complete the job properly at minimum wage as opposed to his or her normal wage rate?

**A: tell us more ie. the current wage vs. the minimum and the actual job that was done.

We are a small business with non-union workers and we provide heavy duty janitorial work for restaurants. The average hourly wage is about $14.00 per hour and the minimum wage in California is $6.75 per hour. Lately our payroll is up and our production is down due to having to rework jobs because our customers have complained that the work has not been done to our normal standards. All of our employees are long term and they know how to do their jobs.

**A: then tell them to do it right at the regular pay or fire their butts. There are lots of people willing to take their place and earn $14/hour. Minimum wage, don't go there.

I just got done laughing. That is what we were thinking, unfortunately the work we do is somewhat specialized and we put a lot of training into our employees as they work at night and they supervise themselves. We try to hire good quality steady people but lately it is like the inmates are trying to take over the asylum. Maybe I should fire the most expendable to wake the others up.

That would be a better solution. It's always risky when you lower wages, although there are ways it can be done. Not the way you suggested though. Harsh as it might seem, you're probably better off making an example of someone and, if necessary, amend your policies on supervision.
