Hello !
I am an employee of the Collins & Aikman Corp. Engineering Center... i work there as my company's Industrial Robotics Programmer.... my position is refered to as simply "Programmer".... i have been with my company for 19 years and im an hourly individual makeing $15.85 per hour... we are NOT union.
Since the creation of my job title some 6 years ago i have been the sole programmer at the Engineering Center.
Within the past year or so our work load has sky rocketed and the management decided to hire on a second programmer to cover another shift.
The job was posted in house as "Waterjet Programmer" pay rate $13.86 per hour.... which is less than most of the pay rates here at E.C.
As i surmised NO ONE in house wanted the job at that pay rate and soon i heard that it was being advertised in a local newspaper help wanted section.
Out of curiosity i got the paper and found the AD.
It read... Manufacturing / Process Engineer ... pay DOE !
Shortly thereafter a man was hired, and placed with me to be TRAINED !!!
I queried the guy and he confessed that management had told him that he would be programming and occasionally they would use him in other departments !!
My feeling is this : My company couldnt get anyone qualified for the pay rate they were willing to offer, so they agreed to hire this guy into another department, one with a pay rate of 17.41 per hour and then ONLY require him to program.... oh boy.
Oh, by the way his TIMECARD is stamped "Programmer"
In the mean time this guy is making more money than me for the same duties.
Is there anything here that isnt legal ???

There aren't any laws that make anything your employer did illegal. They can give the new hire whatever title they want, assign him to a different department, change the job duties, pay him more than you, etc.

What you need to do when you are calm is to discuss your job duties and rate of pay with your boss. If you charge in ticked-off and demand a promtion, pay raise or whatever, the only thing that's going to happen is that your boss is going to get angry too.

Nope. Unfair, possibly, but not illegal and not even all that uncommon.
