Divorced and still on the loan and title

I'm in California. I divorced my ex husband and we did not use a Lawyer. I went through the courts. I gave him the house. The divorce was finalized and he was awarded the home. I am still on the title and the loan. I want to be taken off and the lender said even though he was awarded the home on the divorce they can not take me off until he refinanced me off the loan. He can not get approved to refinance because he had bad credit. He has modified the loan several times with out my income information and I am still on the loan. If I sign a quitclaim deed will I be responsible for any loans or lens he may get on the property?

If you sign a quitclaim you will still owe for a house you no longer own. All the quitclaim does is transfer your ownership rights to the grantee.

Next time use a lawyer! Because if you had had one from the start, he or she might of had the good sense to insist that the decree order that the house be listed on the open market and remain listed until sold, or in the alternative, that the ex be given a reasonable time to secure a refinance in his name alone. And if not, then listed.

Simply awarding the home to him with no conditions attached was foolhardy. Unfortunately it is very common.

Sorry about the disappointing news regarding a quitclaim deed. But then it would be nice if one could relieve themselves of their financial commitments by their mere signature.
