LOL horsep0wer, I know what you mean about the lawyer. I would think all this is public info and that you have a right to see your info.

I just wanted to type what is on the back of an affadavit of paternity in this state, of course I know it may be different in yours but maybe this will help. I'm going to start with the part we are talking about right now..filing with court.

3.When completed at birth, this Affidavit must be filed with the birth certificate. Under no circumstances will the birth certificate be delayed in order to complete the Affadavit. When completed and filed with the court at a later date, the Clerk of Court wil provide notice to NC Vital Records.


It also talks about other things like genetic testing, being married to someone else during conception or birth, listing father's name on birth certificate, retracting admission of paternity, rights and responsibilities of parents like, custody, visitation and support, inheritance law.

I'd call the hospital again and the courthouse. Maybe the Registrar of Deeds or Clerk of Court would know. It may even be possible to get copies from the Dept of Vital Records.

I just thought of something else too. My husband and I weren't married when our first child was born but to the best of my memory they mailed him a copy of the Affadavit and the rough copy of the birth certificate, not the official one because you have to send off to get that.

I can't believe they don't mail this off to the parents in other states.

Ok, one more thing. LOL!

When you call the courthouse and the hospital, ask if it's possible to have the father's name put on the birth certificate without signing the Affadavit or if it's mandatory it be signed. Then you'll know if you signed it. Then if you did, you get a copy from the courthouse or where ever they tell you to get it. That should be all you need.

Let us know what you find out.

After dozens of phone calls and being transfered around, I ran up to the court house and got a copy of the birth certificate. Then after dealing with the State Department for an hour, they finalyl found the Affidavit I signed and are sending it to me! woo hoo!

We just had to switch lawyers becuase the one we were going to use never called us back for over a week :mad:

Wish us luck, my M-I-L meets with her tomorrow morning (we live 10 hours away). So hopefully we will know whether my husband's paternity was legally established here pretty soon. Then we can move forawrd with the Parenting Plan propsal. THAT is where it will get interesting to say the least *sigh*.

I wish SO much that we lived closer so I could do that instead of paying/waiting on a lawyer!! Way to go!!!!!!
